What is Alimony?
Alimony or spousal support is a payment made to one spouse by the other for support after a separation or divorce. The reason most courts award alimony is to avoid any unfair economic consequences of a divorce and provides the lower-income spouse with money for living expenses. There are four types of alimony:
Temporary Alimony: Support is ordered when the parties are separated, prior to divorce.
Rehabilitative Alimony: Support is ordered to a lesser-earning party for a period of time to become self-sufficient.
Permanent Alimony: Support is ordered to the lesser-earning party until the death of the payer, recipient or the remarriage of the recipient.
Reimbursement Alimony: Support is ordered as a reimbursement for expenses incurred by a party during the marriage (ex: educational expense)
How much money is awarded for alimony?
Unfortunately, there is no set amount of money that is awarded, it depends on individual cases.
How will I know if I will be awarded alimony?
Traditionally, alimony was paid solely by the husband. However, today there is gender equality and either party can be awarded alimony. As a result, many different factors weigh in an alimony decision. A judge will base his decision usually on a combination of the following:
- Length of marriage
- Time separated while still married
- Income of the parties
- Future earnings of the parties
- Health of the parties
- Fault in marital breakdown
- Gender of the recipient
Separation or divorce is a life changing event. During a separation or divorce, everyday life can become extremely stressful and cause a lot of pain.
